Terms and Conditions

Please carefully read the following Terms and Conditions (hereinafter “Agreement”) set forth by Dynamic Combative Solutions, L.L.C., (hereinafter “DCS”) before agreeing.By checking box to this Agreement, you hereby agree to be bound by the terms and all terms incorporated herein by reference.It is the responsibility of you, the student, to read and understand the terms and conditions before attending any class with DCS.If you do not understand or do not agree with this Agreement in its entirety, please do not check the box to this document.

By checking box to this Agreement, the undersigned (hereinafter “Student”) agrees to the following terms and conditions:

Cancellation and Refund Policies. All sales are final. Student may not cancel and/or request a refund once a class is scheduled. All cancellations and/or refunds will be made at the discretion of DCS in a case-by-case basis.

Rescheduling Policy. Any and all attempts by Student to reschedule a class requires a notice from Student to be submitted to DCS no later than twenty-four (24) hours before the class is scheduled to begin. No requests to reschedule a class will be honored if that class is scheduled to begin within twenty-four (24) hours. If Student fails to reschedule twenty-four (24) hours before the start of class, Student will not be refunded for that class. Only one reschedule per student per class is permitted.

Prerequisite Standard. Student has read, understands, and has met the prerequisite standard set forth by DCS prior to when class is scheduled to begin. It is the sole responsibility of Student to meet the minimum qualifications and prerequisites required to attend any course at DCS before the scheduled class begins. Failure to meet the minimum qualifications required may result in sanctions, including but not limited to, immediate dismissal.

Attendance. It is the responsibility of Student to be present for class on time, with proper clothing, functional gear, and required firearms to safely and successfully perform any course of fire and drills during class. Failure to comply with this requirement will result in immediate dismissal from class.

Proper Gear in Proper Condition. Student will have all the listed materials (hereinafter “gear”) required for class in the proper condition before attending class. If Student does not have proper gear in the proper condition before the start of class, Student will be dismissed from class and will not be allowed to reschedule.

Proper Attire. Student agrees to dress in proper and practical clothing, footwear, and gear during the duration of the class. Student may be dismissed from class if said clothing, footwear, or gear is damaged or defective, represents a safety hazard, or does not meet the technical standards required to safely perform drills during the duration of the class. At the discretion of the instructor, Student may participate in class wearing any clothing, footwear, or piece of gear previously inspected and approved by the instructor.

If Student fails to attend class dressed in proper and safe attire, Student may be excused at any time prior to or during class. Furthermore, Student may be asked to change or may not be allowed to use certain clothing, equipment, or attire, solely based on the instructor observations that day.

Minimum Standard. If Student does not meet the basic minimum standard required to continue class, Student will fail the class and will not be allowed to continue or be issued a refund.

Age Requirement. To register for a class, Student must be twenty-one (21) years or older. To attend any class, Student must be eighteen (18) years or older at the time of attending class.

If Student is under the age of twenty-one (21), they must be accompanied by a parent or guardian who has successfully completed the class in advance. Some exceptions may be made with regard to the accompanying parent or legal guardian’s course-completion requirement.

Additionally, Students under the age of twenty-one (21) years (hereinafter “Minors”) must be accompanied by one or both parents, or legal guardian at all times while on the premises under the control of DCS. The Minor’s parent(s) or legal guardian are responsible for executing direct supervision of the minor throughout the entire duration of the class. The Minor’s parent(s) or legal guardian are fully responsible for the behavior of the Minor while attending a class. The parent(s) or legal guardian assume total responsibility for the physical wellbeing and integrity of the Minor during the duration of the class.

Handgun Rental Policy. If Student is between the ages of eighteen (18) and twenty-one (21) and wishes to take a course involving a handgun, Student must bring their own firearm and will not be permitted to rent one.

Home Reloaded Ammunition. Home reloaded ammunition is specifically and strictly banned from all our classes. Manufacturer’s reloaded ammunition is acceptable.

Dismissal. DCS instructors reserve the right to excuse or dismiss any person from class at any time and for any reason at the full discretion of the DCS instructor for that class.

Conduct During Class. Any offensive, disrespectful, or disruptive behavior during the duration of the class will result in immediate dismissal. Instructor has sole discretion and authority to dismiss anyone for disruptive or disrespectful behavior during class.

Arbitration. Any dispute, controversy, or claim arising out of or relating in any way to this agreement, including without limitation, any dispute concerning the construction, validity, interpretation, enforceability, or breach of the agreement, shall be exclusively resolved by binding arbitration upon a Student’s submission of the dispute to arbitration. In the event of a dispute, controversy, or claim arising out of or relating in any way to this agreement, Student shall notify DCS in writing thereof within thirty (30) calendar days of the date the claim. DCS and the claimant shall meet at an agreed upon location to attempt to resolve the dispute in good faith. Should the dispute not be resolved within thirty (30) days after such notice, Student shall seek remedies exclusively through arbitration.

Notice to Instructors. Student acknowledges that engaging in strenuous physical activity in conjunction with the use of firearms for the purpose of gaining training and firearms education whether indoors or outdoors locations is inherently hazardous. Student fully understands and agrees that self-defense education is physically demanding and may interfere with Student’s medical conditions. Prior to registration for a class, it is Student’s responsibility to promptly inform DCS in writing of any medical or physical condition that may preclude, prevent, limit, or otherwise cause a risk to Student’s health, well-being, or physical integrity in any way and to any degree while attending a DCS class. Failure to inform DCS before registering for a class of any pre-existing medical condition could result in immediate dismissal from class.

Universal Firearms Safety Rule. Student agrees that any violation of the “Universal Firearms Safety Rules” during any portion of the class or after the class will result in immediate dismissal from class at the sole discretion of the instructor and/or Student being permanently banned from future training. If Student is not familiar with the “Universal Firearms Safety Rules,” Student must ask any DCS staff member for written information about the Firearms safety rules prior to the beginning of the class. The “Universal Firearms Safety Rules” are included at the beginning of any class and are listed below:

(1) Treat all firearms as if they are loaded.

(2) Always keep all firearms pointed in a safe direction.

(3) Always keep your finger off the firearm’s trigger and along the slide/receiver of the firearm until your sights are on the target and you have made a conscious decision to shoot the firearm.

(4) Always know your target, what is beyond it, and what is around it.

(5) Always maintain security of your firearm.

Duty to Follow Instructor and Facility Commands. Student agrees to follow all commands made by the class instructor or by the facility’s staff at all times. Failure to comply with such instructions or commands made by the class instructor or by the facility’s staff shall result in Student’s immediate dismissal from class.

Duty to Follow Facility Rules. DCS solely provides training services, and therefore, uses multiple facilities to conduct classes. Student must respect and comply at all times with the individual rules, policies, and instructions of these facilities, which may be stricter than the policies set for by DCS from time to time.

Duty to Report Violations and Safety Concerns. Student agrees to notify and report to the instructor or a member of the DCS staff if they witness or are aware of any safety violations or concerns that may arise at any time. Failure to fully disclose all known information relevant and related to such violations or concerns shall result in Student’s immediate dismissal from class. Student will not be permitted to reschedule class if dismissed from class for this reason.

Damage to Facilities or Property. In case of damages caused intentionally or accidentally by Student to any equipment, gear, or property owned or leased by DCS during the duration of the class, Student will be held legally and financially responsible for said damages. Student agrees to cover any and all monetary expenses as a result of compensatory damages, indemnification to DCS and its managers and principals, property owner or business of the facility leased.

Photo/Video/Voice Release and Use of Likeness. Student understands that DCS and its instructors may record Student at any time before, during, or after the end of class for DCS marketing purposes. Such recording includes, but is not limited to, still photography, portable video camera, cellular phone, or any other device. Student consents to such recordings in the manner of photography, voice, or video recording. Recorded material in any format, which includes digital and non-digital form, becomes exclusive property of DCS.

Student also agrees that such recordings of Student or Student’s likeness may be used by DCS on social media for marketing purposes.

Student is strictly prohibited from taking any photos or videos at any time before, during, and after the class without the express authorization granted by the instructor for that class and other students participating. Authorization granted expressly by a class instructor can be revoked by the class instructor or DCS at any time before or during the class and for any reason.

Choice of Law. Any dispute under this Agreement or related to this Agreement shall be decided in accordance with the law of the State of Arizona.

I CERTIFY THAT I HAVE READ THE ABOVE AGREEMENT IN ITS ENTIRETY, AND I FULLY UNDERSTAND ITS CONTENT AND HAVE discussed any questions or concerns regarding this AGREEMENT with DCS PRIOR TO AGREEING BELOW. I AM AWARE THAT THIS IS A LEGALLY-BINDING CONTRACT, AND AGREE TO IT OF MY OWN FREE WILL.

Parents or Guardians of Minors. IF UNDERSIGNED STUDENT IS UNDER TWENTY-ONE (21) YEARS OF AGE, the signature of the parent(s) or legal guardian of the minor student is must be provided in addition to Student’s signature as a requirement for the minor student to participate. By signing below, the parent or guardian of the minor STUDENT acknowledges that he/she has read the above agreement in its entirety and has discussed any questions or concerns regarding this agreement with dcs PRIOR TO AGREEING

By agreeing to these terms and conditions you certify that

1. you are not under indictment or found guilty in any court for a felony, or any other crime for which the judge could have imprisoned you for more than one year.

2. That you have never been convicted in any court of a felony, or any other crime for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation?

3. That you are not a fugitive from justice.

4. That you Are not an unlawful user of, addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: the use or possession of marijuana remains unlawful under federal law regardless of whether it has been legalized or decriminalized for medical or recreational purposes in the state where you reside.

5. That you have never been adjudicated as mental defective OR have you ever been committed to a mental institution.

6. That you have never been discharged from the Armed Forces under dishonorable conditions?

7. That you are not subject to a court order restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner.

8. That you have never been convicted in any court of a misdemeanor crime of domestic violence.

a. If you have, the conviction must be been set aside or vacated.

i. You will be required to show written proof before class starts

9. That you are a U.S. citizen.

a. Or that you show proof that you’re legally allowed to train in the U.S.

i. You will be required to show written proof before class starts.

10. That you understand that any statements that I did not answer truthfully or honestly may result in criminal prosecution and/or fines and/or imprisonment.
